NOWFit Terms of Service (Client App)

1. Agreement to Terms
These Terms of Service (“Terms”) form a legally binding agreement between you and NOWFit, Inc. (“NOWFit,” “we,” “us,” or “our”). By downloading, installing, accessing, or using the NOWFit mobile application (the “App”) or any related services, features, or content provided through it (collectively, the “Service”), you agree to be bound by these Terms, our Privacy Policy, and any supplemental policies or legal notices that may be presented within the Service. If you do not agree with these Terms, you must not access or use the Service. Your use of the Service constitutes ongoing acceptance of these Terms, including any changes made.
2. Eligibility and Account Registration
You must be at least 18 years old to use the Service. If you are under 18, you may only use the Service with the consent of a parent or legal guardian, and your coach must verify this consent as part of onboarding. You agree to provide complete and accurate registration information and to keep it updated.
You are solely responsible for maintaining the confidentiality of your login credentials. You may not share your account or credentials with anyone else. If you become aware of unauthorized use, you must notify us immediately.
3. Description of Service
NOWFit provides a digital platform that connects clients with fitness professionals (“coaches”) who use the NOWFit coaching platform. Through the App, clients may:
View, log, and track workouts and nutrition plans
Communicate with coaches via direct chat and messaging
Receive plan updates, calendar tasks, check-in requests, and habit tracking
Upload progress photos, journal notes, or reflections
Access AI-driven guidance based on coaching parameters (if enabled)
Integrate wearable and health-tracking data to enhance analytics
Participate in future social features such as group chat, leaderboards, or shared goals
NOWFit itself does not provide health, wellness, medical, nutritional, or training advice and acts solely as a service provider for the delivery of such services through coaches.
4. Relationship Between Client and Coach
Your use of the Service involves interaction with a coach who may be an independent business owner. You understand and agree that:
The coach is solely responsible for their advice, programs, and communication with you
NOWFit is not a party to the transaction or agreement between you and your coach
Any disputes regarding pricing, coaching quality, outcomes, or communication must be addressed with your coach directly
You acknowledge that any payment you make through the platform is routed to your coach via a Stripe payment processing integration. NOWFit facilitates this infrastructure but does not serve as a legal agent or medical advisor.
5. Payments and Refunds
Payment for coaching services is transacted via Stripe. By using the Service, you authorize Stripe and any other payment processing providers used by your coach to charge your designated payment method.
Payments are non-refundable unless otherwise arranged directly with your coach. NOWFit does not issue or mediate refunds and disclaims all liability related to financial transactions between you and your coach.
6. Use of AI and Smart Features
The App includes optional AI-powered tools designed to improve the client experience. These tools may provide:
Goal reminders or motivational prompts
Automated wellness check-ins
AI-generated summaries based on your habits, entries, and goals
You may choose to disable direct AI communication at any time through the app settings. However, anonymized data may still be used to generate insights or recommendations visible to your coach.
AI responses are strictly informational and are not substitutes for professional or medical advice. You should always defer to your coach or healthcare provider for personalized guidance.
7. Health Disclaimer and Assumption of Risk
Physical activity carries inherent risks. By using the Service, you affirm that:
You have consulted a physician and are medically cleared for exercise
You understand that fitness or nutritional programs may cause discomfort or health complications
You accept full responsibility for your actions and results
You waive any liability against NOWFit and your coach for injuries, health outcomes, or dissatisfaction
NOWFit is not responsible for any injuries, health deterioration, allergic reactions, or unintended consequences resulting from use of the App or services received via the App.
8. User Content
You may upload or submit photos, logs, reflections, form submissions, and other materials (“User Content”). You retain ownership of your User Content, but by uploading it, you:
Grant NOWFit a limited, non-exclusive license to display, process, and store such content within your account and to your assigned coach
Represent that your content is accurate, lawful, and does not violate third-party rights
We do not claim ownership of your User Content and will not use it for any public marketing without your consent.
9. Data Privacy and Communication
Please review our Privacy Policy for detailed information on how your data is collected, used, and protected.
NOWFit collects client data to:
Deliver and personalize services
Train internal AI models (in anonymized form)
Help your coach monitor your progress and adapt your plans
While you may disable AI messaging, your data may still support backend optimization features.
By providing your email or phone number, you agree to receive transactional communications and optional messages from your coach. NOWFit may send product updates or marketing communications, which you may opt out of at any time.
10. Acceptable Use
You agree not to use the Service to:
Harass, abuse, or threaten others
Upload offensive or inappropriate content
Misrepresent your identity or fitness status
Share account access with others
Reverse-engineer or copy App features or AI content
Circumvent usage limits, coaching agreements, or payment terms
Violation of these terms may result in account suspension or termination.
11. Account Termination
You may terminate your account at any time through your coach or by submitting a request to support@nowfitonline.com. Upon termination:
You will lose access to the App and all features
Your coach may retain a backup of data for compliance or ongoing support
Any open charges or pending payments may be processed
NOWFit reserves the right to terminate any account for violation of these Terms or illegal activity.
12. Intellectual Property
All platform code, features, designs, and content (excluding User Content and Coach Content) are the intellectual property of NOWFit, Inc. You may not reproduce, distribute, modify, reverse-engineer, or commercially exploit any part of the Service without written consent.
13. Limitation of Liability
To the fullest extent permitted by law, NOWFit disclaims all liability related to:
Health consequences, injuries, or results from use of the App
Misuse or misunderstanding of AI tools
Communication breakdowns between you and your coach
Unauthorized access due to credential sharing or insecure devices
In no event shall NOWFit’s liability exceed $100 USD or the total amount paid by you for use of the Service within the previous six months.
14. Dispute Resolution
These Terms are governed by the laws of the State of Nevada. Any disputes shall be resolved by binding arbitration in Clark County, Nevada. Class action waivers apply. Each party is responsible for its own legal costs unless otherwise determined.
15. Updates to Terms
NOWFit reserves the right to modify or update these Terms at any time. Material changes will be posted in-app or via email. Continued use of the Service constitutes acceptance of updated Terms.
