These Terms of Service (“Terms”) form a legally binding agreement between you (“you” or “your”) and NOWFit, Inc. (“NOWFit,” “we,” “us,” or “our”). By downloading, installing, accessing, or using the NOWFit HQ mobile application (the “App”) or any related services, features, or content provided through it (collectively, the “Service”), you agree to be bound by these Terms and our Privacy Policy.
If you do not agree with these Terms, you must not access or use the Service. Your continued use of the Service constitutes ongoing acceptance of these Terms, including any updates.
You must be at least 18 years old and have the authority to enter into these Terms. By using the Service, you represent that you meet these requirements.
You agree to provide accurate, complete registration information and keep it up to date. You are solely responsible for the security of your account credentials and for all activity that occurs under your account. You may not share, transfer, or authorize others to use your credentials. If you suspect unauthorized access, notify us immediately at support@nowfitonline.com.
NOWFit HQ is a community and education platform for online fitness and wellness coaches. Through the App, you may:

All courses, lessons, knowledge base articles, guides, and other educational materials provided through the Service (collectively, “Educational Content”) are for informational and educational purposes only. Educational Content does not constitute professional, legal, financial, medical, or business advice.

The NOWFit HQ community is a professional space for coaches. By participating, you agree to:
NOWFit reserves the right to remove content, restrict access, or terminate accounts for violations of these community standards at our sole discretion and without prior notice.
You may post, upload, or share messages, media, comments, and other materials within the Service (“User Content”). You retain ownership of your User Content. By submitting User Content, you grant NOWFit a non-exclusive, worldwide license to display, store, and process such content within the platform to deliver the Service.
You represent that your User Content:
We do not claim ownership of your User Content and will not use it for external marketing without your consent. NOWFit may remove any User Content that violates these Terms at any time.

All platform code, features, designs, courses, Educational Content, branding, and materials (excluding User Content) are the intellectual property of NOWFit, Inc. or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal and professional use.
You may not reproduce, distribute, modify, create derivative works from, publicly display, reverse-engineer, or commercially exploit any part of the Service or its content without prior written consent from NOWFit.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the practices described in the Privacy Policy.
By providing your email address or phone number, you agree to receive service-related communications from NOWFit. You may opt out of non-essential communications at any time through your account settings.
The Service may contain links to or integrations with third-party websites, services, or content. NOWFit does not control, endorse, or assume responsibility for any third-party content or services. Your use of third-party services is at your own risk and subject to those third parties’ terms and privacy policies.
The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
NOWFit does not warrant that:
To the maximum extent permitted by applicable law, NOWFit and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or business opportunities, arising out of or related to your use of the Service.
In no event shall NOWFit’s total aggregate liability arising out of or related to these Terms or the Service exceed one hundred dollars ($100).
You agree to indemnify, defend, and hold harmless NOWFit, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

NOWFit reserves the right to suspend or terminate your access to the Service at any time, for any reason, including but not limited to violation of these Terms, community standards, or applicable law. Upon termination, your right to access the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will remain in effect.
These Terms are governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration in Clark County, Nevada, in accordance with the rules of the American Arbitration Association. You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action.
You must bring any claim within one (1) year after the cause of action arises, or the claim is permanently barred.
NOWFit may modify these Terms at any time. If we make material changes, we will notify you via the App or email. Your continued use of the Service after such notification constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and NOWFit regarding your use of the Service and supersede any prior agreements or understandings.
